Climate Change & Clean Energy

Mallesons is experienced in the structuring and documenting of foreign investment transactions in China’s renewable energy sector. We are also one of the few firms with a leading and well recognised practice focusing on climate change and clean energy matters.

The team consists of lawyers from our corporate/mergers & acquisitions, financial services, dispute resolution, projects, construction & environment and tax practices based in China and Australia. It is a strong interdisciplinary group with a wide array of skills and deep market experience which are essential to assisting clients in clean energy investments and carbon finance, where new concepts and innovation are the norm.

In 2011, we expect to see great emphasis on environmental clean-up and efficiency as we are now entering phase two of the Ministry of Environment's remediation plan for contaminated land in China. This stage coincides with the five year plan, up until 2015, and will see intense investment in both renewable energy and environmental work across the region, with great opportunities for foreign investment.

Our recent track record includes advising: 

  • CDM projects on structuring and PRC-specific legal issues of projects in the wastewater, wind power, biomass, geothermal and transportation energy efficiency sectors
  • European power companies in negotiation and finalisation of an ERPA (emissions reduction purchase agreement) with major Chinese State Owned power companies
  • Foreign carbon consultants on the setting up of their China businesses, including advice on the structuring of investments and cooperation with Chinese project management entities
  • Investment banks in their investments in environmental efficiency and waste water treatment across China.
