Arbitration in respect of a luxurious development in Hong Kong
Our client is the main contractor of a luxurious residential high rise in Hong Kong. It is a member of a blue chip developer listed on the main board of the Hong Kong Stock Exchange The value of the project amounts to over HK$900 million. The employer of the project is claiming liquidated damages of over HK$300 million.
HK$200 million arbitration against the Highways Department, Hong Kong
Our team are acting for a Hong Kong contractor in this complex arbitration over construction of extensive tunnels and roadways in Hong Kong. The matter is significant because we expect to make landmark law, on whether certain government agencies - which allegedly caused the delays - can be said to be the “employer” under the particular form of contract in question.
We act for a major developer in proceedings initiated by the Hong Kong Government relating to a development on the Central waterfront which was cancelled. The proceedings are defended and there is a substantial counterclaim. The matter involves complex factual and legal issues. One of the interesting aspects of this matter is that it involves issues of good faith which have not been tested before in Hong Kong.
Residential developer claim against buyers
We act for the developer of a luxurious residential development in Fanling in its court action against the defaulting individual buyers. Our client is a developer listed on the Main Board of the Hong Kong Stock Exchange. We advised on the claim and issued court proceedings including summary judgment application. We also negotiated a favourable settlement by which our client gets back 95% of its claim.
We have been involved in advising the contractors, consultants and suppliers in various casino and hotel projects in Macau. Some of the projects relate to construction management. There are various packages in any one particular project and each package will have different legal and commercial issues. Specifically, we have been helping contractors with the tendering process, risk analysis of the contractual documents, negotiating the terms of the agreement and coordinating Macau legal advisers to advise on particular legal issues.
We also assisted contractors in setting up its Macau offices and obtaining the relevant construction licence.
We are acting for the main contractor for the project for the construction of Route 8 Eagle’s Nest Tunnel.
Asian facilities risk management system for a major investment bank
We developed an integrated risk management system for a major investment bank to be applied across all its Asian centres for the leasing, fit out and maintenance of new premises and facilities. The system is intended to be electronically based and remotely accessible. As far as we are aware, it is the first time an investment bank has taken an integrated risk management system approach to all its leasing, construction, fit out and maintenance of office premises on a regional basis.
