Consistent with developments across financial services regulation, regulators of Australia’s insurance industry continue to recalibrate prudential and market conduct requirements. These changes affect many areas of the industry. Our Insurance team is focused on the impact of these developments on our clients’ businesses and helping them to prepare for their implementation. Our established working relationships with regulators on a national and state level position us well to do so.
With many years of experience advising the industry’s leading players, we provide comprehensive advice on regulation governing the establishment, acquisition and operation of local insurance businesses, and the manufacture and distribution of insurance products. Our team assists with the negotiation of policy terms and other commercial agreements. We advise the insurers and distributors of D&O insurance, as well as major corporates on their D&O cover (along with their deeds of access, indemnity and insurance). We also advise corporates on their financial lines policies - such as prospectus offering liability insurance and financial institutions (civil liability professional indemnity and crime) insurance. We also advise on alternative risk transfer products, including their regulation.
Clients benefit from our close relationships with other specialists across the firm, and our team works closely with our Corporate/M&A, Private Equity, Tax and Project Finance teams on some of the most significant deals across the sector and broader market. We regularly advise corporates on warranty and indemnity insurance policies in M&A transactional and transfer of risk.
