We are continuing to act for the successful Macquarie Bank-led consortium to build and operate the Mitcham-Frankston Tollway, known as EastLink, advising on all land acquisition and tenure issues, drafting amendments to the proposed project-specific legislation, environmental and planning assessments and approvals and native title and Aboriginal cultural heritage issues.
International Power Hazelwood
We are acting in relation to the proposed West Field mine expansion project, advising on such matters as the environmental and planning assessment and approvals process (including representing Hazelwood at the public panel hearings), land acquisition issues (both by agreement and through compulsory acquisition processes) and representing Hazelwood in a challenge in VCAT to the environmental assessment process.
BP
We have recently won a competitive tender to design and establish an on-line multi-functional Health, Safety and Environmental legal compliance tool for all aspects of BP’s Australian, New Zealand and South Pacific operations. The on-line tool will allow any BP user to quickly and accurately determine what health, safety and environmental obligations must be satisfied when undertaking any activity at any of its sites.
This ‘industry-first’ tool combines both expert legal and technical know-how, specifically tailored to meet the stringent and constantly evolving nature of BP’s technical and potentially hazardous business.
Incitec Pivot Limited
We provide detailed legal, technical and strategic advice to Incitec-Pivot Limited in relation to the various environmental, land tenure and planning issues that arise. Notable recent examples include advising in relation to the complex residential and industrial interface issues that are emerging at Incitec’s Portland fertilizer production facility as a result of proposed encroaching residential subdivisions, through to complicated contamination management issues.
APA Group (formerly GasNet Australia)
We are acting for GasNet in relation to native vegetation clearance issues associated with various sites located in Victoria. Native vegetation clearance requirements are becoming one of the most complex and challenging areas to advise on in the Victorian context in particular, given the difficulties associated with interpreting inherently technical guidelines and policies.
McArthur River Mine Expansion (NT)
We have advised Xstrata’s subsidiary, McArthur River Mining, on environmental assessment and regulatory approval processes under Northern Territory and Commonwealth legislation in relation to a proposal to expand the McArthur River Mine. The proposed expansion involves the conversion of the mine from an underground operation to an open cut mine and requires the diversion of the McArthur River.
BG Group’s alliance with Queensland Gas Company
We advised BG Group on its £299 million agreement to establish an alliance with Queensland Gas Company Limited (QGC) in the exploration and development of onshore coal seam gas reserves. The alliance will leverage the expertise of both companies. BG Group is a global energy company and QGC has extensive expertise in the exploration and production of coal seam gas – an established hydrocarbon source in Australia and other countries.
TransApex, North South Bypass Tunnel
We advised RiverCity Motorway on its successful bid for the $1.9 billion concession to design, finance, construct and operate the North South Bypass Tunnel in Brisbane. We also acted for RiverCity Motorway in relation to its IPO.
Sydney Desalination Project - Compulsory acquisition litigation
We advised Sydney Water Limited in relation to the compulsory acquisition of land at Kurnell for the public purpose of a desalination plant. This matter involved a number of complex valuation, town planning and environmental issues made more difficult due to the number of parties that had an interest in the acquired property at the date of the acquisition, which resuilted in seven mostly seperately represented appilicants in the processdings.
Gorgon LNG Project
We are currently acting for Chevron Australia Pty Ltd in relation to the Gorgon Project, a LNG project to extract gas from the Gorgon gas fields and with processing to be located on Barrow Island, an A class nature reserve in northern Western Australia. When constructed, the Gorgon project will be the largest single gas project in Australia and include Australia's first large scale geosequestration project.
