Our team approach any issue with a view to strategic short and long term consequences, including contractual, regulatory and litigation issues.

We advise advertising agencies and agency clients on all legal aspects from documenting the agency/client relationship to pre-vetting creative concepts, story boards and copy, to consumer promotions and advertising standard board and ACCC issues. We have extensive experience in the specialised areas of food, alcohol and motor vehicle advertising.

Our lawyers advise on all aspects of brand protection and exploitation in the advertising and marketing context, including dealing with disputes arising from advertising, promotion, packaging and labelling.

Our advertising and marketing team include lawyers who are amongst Australia’s pre-eminent IP litigators. We have run many landmark cases involving passing off and misleading and deceptive conduct (section 52 of the Trade Practices Act) for advertisements, labelling and get up of products. We have also been involved in many successful negotiated settlements of such litigation.

Our lawyers advise advertisers on the use of celebrity endorsements for their products and advertising campaigns, including drafting the relevant agreements and advice on misleading and deceptive conduct, sports law and ambush marketing, where appropriate.
