 Professional Biography

 
  • John Stumbles is a Legal Consultant in the Sydney office of Mallesons Stephen Jaques. He has expertise in regulation of banking services, payment systems and derivatives and in the law of insolvency, set-off and netting. He has acted for banks in a wide range of syndicated lending programs. The Euromoney Guide to the World's Leading Banking Lawyers consistently ranks John amongst Australia's top banking lawyers. Mr Stumbles has written and lectured on matters relating to the law of banking and finance and insolvency law.

    He has been a speaker at international seminars organised by the International Bar Association and the American Bankruptcy Institute on cross-border insolvency. His expertise in payment systems and insolvency was drawn upon by the Australian Government and Reserve Bank in connection with the introduction into Australia of legislation relating to netting and real time gross settlement.

    In recent times his dual expertise in banking and insolvency law has been drawn upon by banks in structuring workouts for distressed corporate borrowers. Major transactions throughout his career include advising foreign banks on setting up business in Australia, including drafting standard form documentation and procedures manuals and a capital reconstruction to comply with prudential requirements. He has also acted as counsel for the banks in a large number of borrowing programs.

    More recently he has acted as counsel for Australian and offshore financiers in settling standstill and out of court workout arrangements arising out of the collapse of two large Australian-based multinational conglomerates. John acts for the major professional trustee companies operating in Australia, and has advised on domestic and global custody and payment systems.

    John has been nominated as a leading individual in Banking by IFLR 1000 2009 and was also listed as a leading individual in Restructuring and Insolvency by PLC Which Lawyer? 2008. John has been highly recommended in the area of Banking: lenders and borrowers by PLC Which Lawyer? 2008 and 2009 and was listed in the 2009 edition of the Guide to the World's Leading Banking Lawyers produced by Euromoney's Legal Media Group.
