 Professional Biography

 
  • Wayne Leach is a Partner in the Competition Law Group at King & Wood Mallesons in Sydney.

    He has substantial experience advising clients, and liaising with the Australian Competition & Consumer Commission, in relation to competition law issues associated with mergers, joint ventures, industry collaborations, access to essential infrastructure, conduct by dominant companies and other market conduct issues.

    Wayne has represented clients in a wide range of industries, including clients in the coal, gas, resources, agricultural, infrastructure, food processing, ports, financial and aviation sectors.

    Between 2001 and 2002, Wayne worked in the international antitrust practice of a magic circle firm in Brussels. Wayne was also engaged as a Senior Corporate Lawyer at Sydney Airport from 2005 to 2008.

  • advising foreign and domestic clients in a wide range of industries in relation to the Australian competition law aspects of, and liaising with the ACCC in relation to, proposed mergers, joint ventures and strategic alliances
  • advising BG Group plc in relation to its proposed $13.8 billion hostile takeover of Origin Energy Limited, its acquisition of Queensland Gas Company Limited, and its establishment of an export LNG facility in Queensland, Australia
  • advising Cargill, Inc in relation to its proposed acquisition of Goodman Fielder's commercial edible oils and fats business
  • advising a major US-based consumer products corporation and major US-based financial services corporation in relation to the competition aspects of global acquisitions and preparing competition filings in a number of European jurisdictions
  • Access to infrastructure
  • advising Sydney Airport Corporation Limited in relation to the infrastructure access proceedings commenced by Virgin Blue in relation to airside services at Sydney Airport (NCC, Australian Competition Tribunal and appeals, and ACCC access dispute)
  • advising a grain industry participant in relation to the access requirements, and access undertakings required to be submitted to the ACCC in relation to, export grain terminals
  • advising a major coal exporter in relation to the rail track access arrangements in New South Wales and the proposed ACCC access undertaking
  • advising Port Waratah Coal Services Limited, and liaising with the ACCC, in relation to the introduction of a capacity allocation system at the Port of Newcastle and the development of a new long term industry solution for capacity expansion in the Hunter Valley

  • advising Sydney Airport Corporation Limited in relation to the Productivity Commission's review of the regulation of airport services in Australia
  • advising a major port terminal operator and grain exporter in relation to the Productivity Commission's review of Australia's wheat export arrangements
