Professional biography
Katrina Rathie is a Partner of Mallesons Stephen Jaques where she specialises in intellectual property law particularly in the advertising, marketing, consumer goods and media industries. Katrina is a member of the New York Bar and has practised law both in the United States and Australia.
Katrina has over 20 years experience advising on the protection and enforcement of intellectual property rights with a focus on brands, trade marks, mastheads, designs, passing off/look and feel, copyright, misleading and deceptive conduct under the Trade Practices Act, media and celebrity rights.
Katrina and her team provide strategic counsel to pro-actively protect famous brands (clearance, trade mark prosecution, portfolio management) and defensively enforce intellectual property rights via a range of tactics including cease and desist letters, opposition, disputes and litigation.
Katrina is a strategic litigator with a winning track record - she has successfully acted on a number of landmark Australian cases in her area of expertise. Equally, Katrina has succeeded in keeping many of her clients out of Court.
Katrina is a market leader in the advertising, marketing and media law field. She has a comprehensive knowledge of the laws affecting the advertising, packaging, marketing and distribution of fast moving consumer goods and the laws relevant to the rapidly changing publishing and broadcasting industries.
Katrina has acted as the Chair of the Advertising Claims Board and she represents clients in self-regulatory and Court challenges to the legality of advertising campaigns and advises on compliance with advertising, consumer, product and media laws/codes. She has wide experience with negotiating broadcast and media rights, sponsorship, vending, franchise, endorsement, licensing and personality rights.
Katrina has been a driving force behind the "Mallesons in the Community" Program which received a Prime Minister's Special Award for Impact on a Community. She has been a Finalist in the Telstra Business Women's Awards.
The ABC's respected 7.30 Report has recently referred to Katrina as “one of the country's top intellectual property lawyers”. Katrina's reputation as a leading intellectual property and media lawyer in the Asia Pacific region has been acknowledged in international surveys and publications including Chambers Global 2009, Asia Pacific Legal 500 2008/2009, PLC Which Lawyer 2009, The International Who's Who of Trademark Lawyers, Euromoney's Guide to the World's Leading Trade Mark Law Practitioners and Euromoney's Guide to the World's Leading Technology, Media and Telecommunications Lawyers.
