  • Andrew Gray is a Partner in the Mallesons Workplace and Employee Relations Group. Andrew specialises in all aspects of workplace relations and employment law including:
    • Negotiating and drafting individual and collective employment agreements (with particular expertise in executive employment arrangements)
    • Remuneration and incentive arrangements
    • Employee retention arrangements
    • Agreements for the protection of confidential information, intellectual property and non-compete provisions and the enforcement of these arrangements
    • Managing legal risks associated with the termination of employment
    • Strategic industrial relations advice
    • Unfair/wrongful termination claims
    • Advice and representation concerning strategies to manage and resolve industrial/employment disputes
    • Employment and industrial relations issues arising in mergers, acquisitions and outsourcing transactions
    • Employment issues arising in insolvency situations
    • Compliance with discrimination/equal opportunity laws and defending clients in the resolution of sensitive disputes in this area
    • Compliance with occupational health and safety laws, assisting clients with investigations and prosecutions under OHS laws
    • Workplace culture and privacy issues.

 Recent Matters

 
  • Advising several large employers on the implications of Labor's new Fair Work legislation for their business including Xstrata, Nestle, Citigroup, Chubb, Sensis, GrainCorp and McKinsey & Company and Microsoft among others
  • Advising companies such as Nestle and Chubb on responding to industrial action which has included representation before industrial tribunals
  • Representing RailCorp in major occupational health and safety investigations and prosecutions including the prosecution into the Waterfall train derailment
  • Advising corporate clients including Xstrata, Westpac, BlueScope Steel, NAB, Telstra, GrainCorp, Macquarie Bank, CVC, CHAMP and AMP on industrial relations and employment issues associated with the sale, purchase and restructuring of businesses (including outsourcing of activities) in a range of industries including mining, construction, electricity, telecommunications, finance and the services sector
  • Acting for clients including Fairfax, GrainCorp, Nestle, Chubb, Sensis and PwC in defending unfair contract claims and unfair dismissal claims in State and Federal industrial tribunals, and
  • Representing corporate clients in their successful defence of prosecutions under the Occupational Health & Safety Act (NSW) arising out of workplace fatalities including proceedings before the Full Bench of the Industrial Court of New South Wales
