 Professional Biography

 
  • Ann Newbrun is a Special Counsel in the Sydney office of Mallesons Stephen Jaques. Ann specialises in providing commercial and regulatory advice to the general insurance sector, including insureds, insurers, intermediaries and industry bodies.

    Ann’s experience includes advising on the implications of new legislation and regulation, establishment issues, the sale and distribution of insurance, including setting up distribution arrangements and joint ventures, and promotional campaigns. In doing so, she has advised extensively on the application of the financial services regulation and compliance with insurance specific legislation.

    Ann also advises on insurance coverage issues which involves drafting and settling insurance products. She has undertaken insurance program reviews and advised on other risk management facilities.

  • Preparation of submissions and liaising with Treasury on the development of amendments to the Insurance Act 1973, regarding the regulation of unauthorised foreign insurers
  • Drafting, reviewing and amending insurance contracts, including buyers and sellers warranty and indemnity insurance
  • Commutations of insurance portfolios, including reinsurances and deauthorisations
  • Strategic alliances between industry organisations and large corporates with significant customer databases
  • Advice on distribution agreements and the structure of distribution systems, including internet based, agency and authorised representative arrangements
  • Advised on non-insurance risk management facilities such as discretionary mutual funds, including analysing the application of financial services regulation
  • Application of the Private Health Insurance Act, National Health Act and Medical Indemnity (Prudential Supervision and Product Standards) Act
  • Review of insurance programs of multinational corporations
  • Acted for Marsh, a New York based insurance broker and risk management specialist, in the purchase of Heath Lambert's operations in Australia, New Zealand and Papua New Guinea (March 2004)
  • Advised AMP on regulatory and portfolio transfer aspects during the sale of AMP General / GIO General insurance business to Suncorp Metway
  • Liaised with Treasury and ASIC during the consultation stages preceding the Financial Services Reform Act and advised general insurance industry participants on all aspects of financial services reform, in particular, the application of the licensing regime, exemptions and disclosure requirements
  • Prepared an Australian Financial Services licensing kit for an industry organisation
