 Professional Biography

 

  • Michael Lundberg is the Partner in Charge of the Perth office of King & Wood Mallesons, and a Partner in the Perth Dispute Resolution Group.

    Michael represents clients in a broad range of commercial and corporate disputes including complex litigation in the Supreme Court of Western Australia and the Federal Court of Australia, as well as in arbitration proceedings and expert determinations. Michael's practice has focused on disputes arising in the energy and resources sector in Western Australia (including iron ore, nickel, natural gas, gold, and coal related matters).

    Michael has acted for clients in joint venture disputes, royalty disputes, contractual disputes, schemes of arrangement, regulatory investigations commenced by the ASIC and the ACCC, defamation proceedings, and intellectual property matters.

    Michael has worked as a litigator in Western Australia since 1994 and was recognised as a leading Australian litigator in Best Lawyers 2010.

  • Acted for international bank in expedited expert determination proceedings arising from the sale of Australian bank.
  • Acted for resources company in the iron ore and coal sector in joint venture disputes in the Supreme Court of Western Australia and the Supreme Court of Queensland, including successfully defending the validity of dispute resolution clauses in a JVA.
  • Acting for clients in defending defamation proceedings in the Supreme Court and the Court of Appeal.
  • Acted for major WA construction company in Supreme Court proceedings pursuing fiduciary duty claims, contractual claims and freezing orders against various parties.
  • Acted for various clients in undertaking the litigation aspects of schemes of arrangement under the Corporations Act in the Federal Court of Australia, Supreme Court of WA, and the Supreme Court of NSW, including the Foodland acquisition by Metcash and Woolworths, the HBOS acquisition of BankWest, the ARC Energy acquisition by AWE, and the BHPB acquisition of UMC.
