 Professional Biography

 
  • Peter Stockdale is a partner based in the Sydney office of the firm. Since he became a partner in 1988 he has practised in the Dispute Resolution group, specialising in professional risk, insurance and reinsurance with a particular focus on complex or catastrophic claims.
    Peter has a special interest in professional service firms and the wide variety of risks to which they are exposed - internally and externally - and has acted for most of Australia's law firms and their insurers since the late 1980s. He has developed a comprehensive understanding of the insurance market at both an underwriting and a claims level.
    Peter has been consistently nominated as one of the leading litigators and insurance lawyers in Australia in all of the major market research journals for over a decade. His clients speak of his expertise and knowledge of the insurance and reinsurance markets as well as his pragmatic approach to solving disputes and "his good practical manner".
    Apart from acting for many of the world's leading professional indemnity insurers and their insured, Peter has been responsible for the firm's own risk management programs and spends time training, speaking and constantly challenging and reinventing the firm's own risk models as well as leading the firm's risk management group and chairing its Practice Excellence and Risk Committees.

 Recent Matters

 
  • Given his client base, much of Peter's work is not done in a public forum, but he acted in Vella v Permanent Mortgages claim (establishing the limits in NSW of the Civil Liability Act) and for the reinsured interests in Gordian v Westpoint and others (a case determining the reach of the arbitration provisions in the context of reinsurance claims in Australia);
  • Peter has been involved in most of the major Judicial Enquiries and Royal Commissions over the last 10 years - including the Glenbrook and Waterfall Enquiries (for Railcorp), the HIH Royal Commission (for reinsurers) and the AWA "Cole Enquiry" (for the interests of directors).
