This article, by Andrew Floro and Howard Shih, was published in the Trade Practices Law Bulletin. It examines a UK decision in favour of the US government's request to extradite a former CEO on criminal charges of price fixing and obstruction of justice. Its application in Australia is also considered.

International arbitration update

This Update details the landmark Federal Court decision in Comandate Marine Corp v Pan Australia Shipping Pty Limited [2006] FCAFC 192. One of the issues in the case was whether claims of misleading and deceptive conduct under the Trade Practices Act fell within the scope of an arbitration clause. The Comandate decision widens the scope of arbitration clauses to include issues ancillary to the formation of the contract.

Comparative advertising loses its lustre

In this Update, we note the lessons to be learned from the Federal Court’s decision in Johnson & Johnson Pacific Pty Ltd v Unilever Australia Limited (No 2). The comparative advertising strategies used in that instance were found to breach section 52 of the Trade Practices Act.
