Unsolicited IP Services - 30 July 2009

A number of our clients have recently received correspondence from third parties seeking payment for unsolicited IP services. The most recent invoices circulating amongst clients are from TMP (Trademark Publisher GMBH). TMP is seeking payment from registered owners of Australian trade marks to publish the trade mark owner's trade mark details in the TMP-INFO-REGISTER for a three year period. TMP requests payment of $1.450,00 (currency unspecified).

Publication in TMP-INFO-REGISTER does not confer any additional legal rights upon the trade mark owner, nor does it confer any obvious benefits. Moreover, IP Australia's website contains information about unsolicited IP services (see here). The site states that TMP (amongst others) is known to have disseminated deceptive communications.

TMP is an Austrian company with a street address in Sydney.

Trade mark owners are urged not to make these payments. Please let us know if you have any queries in relation to these notices.
