Mutual Fund "Best Practices" for Hyperlinking to Third-Party Sites Developing

On 26 October 200, Barry Barbash, a U.S. lawyer spoke at an American Law Institute - American Bar Association conference on Investment Management Regulation. He reported that "best practices" are beginning to develop in relation to hyperlinking from mutual fund Web sites to third-party web sites. For example, some fund sites use disclaimers that pop up when a user clicks on a link to a third-party web site.

These disclaimers can indicate that the information on the third party site was believed to be accurate at the time the link was created but subsequently might become outdated. Disclaimers are also being used for hyperlinks to third-party reports that mention the company. Such disclaimers typically emphasize that the company does not necessarily endorse the report, but is providing a link solely for informational purposes.
