Karmen is a Senior Associate in the dispute resolution team in Sydney. She acts in a range of commercial disputes in the Supreme and Federal Courts, particularly those involving the building and construction. Karmen also has experience in domestic arbitration, as well as construction specific disputes regarding the security of payment regime and contractual dispute mechanisms, including expert determination.

Karmen deals with various issues including delay and disruption, extensions of time, defect rectification variations, as well as assisting with day-to-day administration of live projects for various clients.   

Karmen's experience includes:

  • Infrastructure NSW re Sydney Fish Market: defence of Supreme Court proceedings brought by Multiplex for $254m in respect of time overrun of new Sydney Fish Market, with the subsequent cross-claim against the tenant Sydney Fish Market for the same amount.
  • Infrastructure NSW re Sydney Fish Market: Govt/Developer role acting in defence of claims brought by Sydney Fish Markets as to the scope and price of the new facility to be constructed in Blackwattle Bay, Sydney.
  • The HYLC joint venture (CPB Contractors and Hansen Yuncken): acting over an 8-year period in relation to various disputes with the South Australian government arising from the $1.85bn Royal Adelaide Hospital project, including a 12-week arbitration and Federal Court proceedings.  
  • WestConnex Stage 3A: Acting for the Principal Sydney Motorway Corporation in both upstream disputes (against TfNSW) and downstream disputes (against the head contractor Acciona Samsung Bouygues JV) in relation to the under construction M4-M5 Link tunnel toll road in Sydney.
  • Roberts Jones Badgerys Creek Pty Ltd: acting for the landowner in Land and Environment Court proceedings regarding the compulsory acquisition of land for infrastructure associated with the Western Sydney International Airport and Precinct. 
  • Maules Creek Coal Pty Ltd: acting for a mining operator in defence of a criminal prosecution brought by the Environmental Protection Agency in the Land and Environment Court. 
  • Gateway South Joint Venture: advising the Fulton Hogan Laing O'Rourke Joint Venture (Gateway South) on the Darlington Road Upgrade dispute.
  • Qube Holdings: acting in relation to various disputes arising from the Moorebank Intermodal Project.
