Sujen is a recognised practitioner in regulatory investigations, enforcement proceedings, and class action defence, with particular depth in financial services litigation.
He has extensive experience advising clients on complex regulatory matters, including recently acting for a leading non-bank lender and a healthcare and financial services group in relation to ASIC investigations and subsequent civil penalty proceedings in the Federal Court concerning the Design and Distribution Obligations (DDO) regime, one of which was the first case in Australia testing the ‘reasonable steps’ obligation under the DDO.
His regulatory practice further includes advising a prominent financial services provider in connection with an ASIC investigation and civil penalty proceedings relating to historical advertising, as well as advising a major alternative asset manager on interim stop orders and a letter of concerns issued by ASIC.
In addition to his regulatory enforcement practice, Sujen has significant experience in class action defence, including assisting in the defence of multiple Federal Court class actions concerning superannuation fees, insurance-related financial advice and liability for insurance policies.
