Our law firm’s experience in the asset and aircraft finance industry, includes: 

  • Deutsche Bank/Castlelake/Virgin Australia Airlines: a financing of five Boeing 737 Aircraft and two 777 Boeing Aircraft – financed sale and leaseback for Aircraft for Australia Airlines. 
  • Rex Airlines: negotiated and documented the operating lease (with financing) for its first 737 Aircraft to enable its debut in the golden triangle of Sydney – Melbourne – Brisbane to create a competitive landscape with Qantas and Virgin.  
  • BNP Paribas/Goldman Sachs/Castlelake: financing 11 Boeing 737 Aircraft via sale and leaseback for Aircraft for Australia Airline. 
  • CBA: on largest ever privately funded UK rolling stock procurement, a £1.1 billion. 
  • Japanese bank (Hong Kong): refinancing facility for eight Boeing 737-800 aircraft. 
  • Macquarie Bank: vendor loan note arrangements on sale of Digitek. 
  • CBA/Qantas: advising the Lender Syndicate in respect of the issue by an Australian airline of A$450 million credit enhanced notes supported by aircraft security. 
  • Leading Airline Administration: acting for numerous secured creditors and lessors (40+ clients with 118 Aircraft and associated equipment) in the administration of a leading Australian airline. This involved many issues concerning the Cape Town Convention; civil aviation (CASA) issues concerning aircraft registration, maintenance and operation; negotiations with airports and other lienholders and repossession/operational issues. 
  • Purchaser and Seller (Joint Counsel) (various roles): Providing Australian law advice to purchasers and sellers (on a joint counsel basis) in respect of the sale and novation of aircraft leased to Australian airlines. 
  • Advising various major Australian banks in respect of the government-risk based receivables financing of public transportation concessions (including diesel, hybrid, low-emissions and zero emissions buses, as well as bus depots and associated infrastructure).
