Theresa has over 8 years experience advising on financial services regulation, specialising in anti-money laundering and counter-terrorism financing, financial services and products, financial advice, credit and funds/superannuation regulatory matters.
Prior to joining Mallesons, Theresa was in the Financial Advisers and Financial Services Enforcement team at ASIC, giving her unique insights and a deep familiarity with ASIC’s enforcement approach across various sectors of the financial services industry.
Theresa's experience includes:
- Australian Banking Association:assisting with the preparation of the 2025 Banking Code of Practice and obtaining ASIC approval of same
- A major investment manager: on regulatory matters relating to the securitisation of lending products, including advising on NCCP and NCC implications, responsible lending obligations, enforceability opinions and AML/CTF implications
- A major Australian Bank: on AML/CTF implications relating to the securitisation of RMBS and covered bonds; legal lead on its AML/CTF remediation project (while on secondment); and on various AML matters and the redevelopment of its AML/CTF Program
- A Big 4 Bank: on various financial advice matters
- A major global retailer:on financial product and licensing implications
- A major international bank:on the sale of its consumer banking business, including advising on the AML/CTF implications of the sale, applying for AUSTRAC tipping off exemption, advising on AFSL implications and issues relating to the payment of funds following termination of its ADI licence, and various matters relating to marketing collateral and transaction documents
- A major international bank:negotiating sub-custodian agreements relating to its global custody network and advising on RG133 compliance and AFSL application.
- A major retailer:on NCCP implications of partnering with third-party lenders
- A major car leasing business:assisting with the development of its NCC-regulated consumer leasing business, including drafting standard form documents
- A Big 4 Bank:advice on regulatory matters relating to discretionary pricing, negative interest rates and bespoke financial products
- A Big 4 Bank: in relation to the transfer of its banking business, preparing transfer certificates for APRA approval and advising on AML and business implications of the transfer of deposits
- A major super fund:in relation to the merger with another fund, and preparing the tipping off exemption application and advising on the new fund’s AML/CTF rights and obligations
