Isabel Waters is an experienced Special Counsel in our Dispute Resolution - Corporate, Financial and Commercial group.
Isabel specialises in largescale and complex litigation, class actions and contentious regulatory matters, and is adept at helping clients navigate sensitive and reputationally significant risks.
Isabel has extensive experience acting for corporates, financial institutions, and individuals in disputes involving alleged breaches of contract, misleading or deceptive conduct and other contraventions of consumer protection and financial services laws, and privacy invasions (particularly those arising from cyber breaches).
In addition to her commercial practice, Isabel has experience acting for clients in Royal Commissions, including most recently in the Royal Commission on Antisemitism and Social Cohesion.
Isabel spent five years working in London where she had a particular focus on financial services disputes and internal corporate investigations.
Examples of Isabel’s relevant experience include advising:
- OnePath Custodians in a member class action concerning trustee duties and the management of superannuation and pension products.
- Latitude in relation to aspects of the March 2023 cyber-attack on Latitude (the largest in Australia to date), including the OAIC’s investigation of the same, and defending individual and representative claims.
- Medibank in relation to proceedings arising from its 2022 cyber-attack, which include the AIC proceeding and related representative claims brought in the Federal Court.
- Superannuation funds in relation to potential misleading and deceptive conduct allegations, including a greenwashing investigation commenced by the regulator.
- Insignia IOOF in a securities class action proceeding involving allegations of corporate misconduct.
- Lochard Energy (QIC) in its $1bn claim for damages against Energy Australia in relation to its purchase of the Iona Gas Storage Facility.
