Rebecca Petrie has over 10 years’ experience working on front-end and back-end construction matters for a variety of clients. She has extensive experience in the energy, mining, renewables and infrastructure sectors and specialises in acting for both principals and contractors in major project disputes.
Rebecca has represented clients in many dispute resolution forums including international arbitration, domestic arbitration, Supreme Court litigation, expert determination and mediation.
Rebecca's experience includes:
- Westgate Tunnel Project: acting on a confidential, high-value ($30m+) dispute in connection with the supply for construction of the WGTP in Melbourne.
- Probuild: acting for Deloitte in relation to the voluntary administration of Probuild. This included managing Probuild’s construction portfolio including subcontractor claims and security disputes, various project adjudications and negotiating bespoke and project specific continuation of works contracts and novation deeds with subcontractors to ensure continuity of projects.
- Ichthys Combined Cycle Power Station Arbitration: acting for one of the Consortium members engaged under an EPC Contract to construct a power plant for an onshore gas processing facility, acting in an arbitration under the ICC Arbitration Rules in relation to claims worth circa $1bn by the Consortium and counterclaims worth circa $2bn by the Respondent.
- Department of Transport and Planning: acting for the department in litigation concerning claims brought against contractors relating to non-compliant combustible cladding on various buildings throughout Victoria.
- John Holland: acting for John Holland in an arbitration defending proceedings brought for defects in relation to a coal terminal expansion project.
- Ostwald: acting for the liquidators of Ostwald Bros to recover amounts owing from Seymour Whyte (amounts awarded by an adjudicator and the subject of subsequent payment claims), in both NSW Supreme Court and NSW Court of Appeal proceedings.
- CPB: acting for CPB in relation to various disputes under its contract for the design and construction of a major state highway PPP project in New Zealand.
- Broad construction: advising Broad construction in relation to various disputes with City of Busselton in relation to the construction of a Performing Arts Centre in Western Australia.
- Racing Queensland: acting for Tattersalls on the interpretation of long term agreements with a value of over $100m with Racing Queensland resulting in a negotiated outcome. This dispute involved a deep dive into the historical background as to how these agreements came into play and the role of government in them.
- APLNG: on gas banking strategies, including advice on contractual interpretation, risk and liability, strategy including options / alternatives.
- Thiess-John Holland joint venture: on the $5b Brisbane Airport Link PPP project (tunnel and toll road) in various upstream and downstream disputes concerning access to worksites, audit rights under relationship based contracts, insurance issues, compliance with dispute resolution clauses and professional design errors.
- Transurban: defending a “first of its kind” class action relating to allegations that the amount of administration charges levied against users of toll roads who fail to pay a toll are unreasonable and in breach of its statutory obligations under the Transport Infrastructure Act 1994. This involves the State of Queensland as co-defendants.
