Sam is a dispute resolution practitioner with experience across insurance, construction, real estate and financial services. Sam’s experience extends to litigation conducted in Courts across most States and Territories in Australia, including the High Court. Often brought in at the early stages of a dispute, Sam is adept at negotiation and the use of alternate dispute resolution methods to resolve disputes quickly, cost effectively and confidentially.
Sam’s recent experience includes:
- Lendlease: acting in Supreme Court of New South Wales proceedings in respect of a greenfield property development in south-west Sydney.
- Infrastructure NSW re Sydney Fish Market: acting for Infrastructure NSW in defence of Supreme Court proceedings brought by Multiplex for $258m in respect of time of overrun of Sydney Fish Market, with the subsequent cross-claim against Sydney Fish Market for the same amount.
- Horizon Capital Fund: in respect of assigned claims worth ~$US40 million made under a Trade Credit Insurance policy with the Bond & Credit Co and Tokio Marine. Proceedings are now on-foot in the Supreme Court of New South Wales.
- Dexus: commercial leasing dispute including enforcement proceedings in the Supreme Court of New South Wales in respect of moneys owed pursuant to guarantees.
- AMP Limited: acting in multi-party proceedings arising from a reinsurance treaty.
- Joint venture partner: acting in a dispute in the Supreme Court of New South Wales between joint venture partners concerning allegations of a breach of a restraint of trade included in the joint venture agreement. An application to refer the matter to arbitration in London has been filed. Suppression orders have been made over some of the subject matter of this proceeding.
- FAL Mickleham: defended a breach of covenant case in respect of industrial land, and successfully had the Supreme Court of Victoria amend the relevant covenant.
- Pro bono: acting and advising on various disputes for pro bono clients.
