Emma is a commercial litigator who specialises in complex contractual and corporate disputes in the Supreme Court of Western Australia and Federal Court of Australia, as well as domestic and international arbitration proceedings. Emma advises and acts for clients across a variety of sectors including energy & resources, financial services, property and construction.
Emma’s practice includes providing strategic advice and conducting proceedings regarding joint venture disputes, shareholder and Board disputes, consumer law claims, leasing and property disputes, general corporate disputes and Corporations Act matters (including schemes of arrangement and insolvency disputes) and defamation matters. Emma also assists resources clients with contentious issues arising in relation to obtaining and complying with State and Federal environmental and indigenous cultural heritage approvals.
Emma’s work highlights include
- ASX 100 Energy Company: provided strategic advice to client regarding risks of climate related litigation in relation to key business decisions made by the Board.
- Senate Inquiry: advised a major mining company in relation to the Senate Inquiry into Aboriginal cultural heritage following the Juukan Gorge incident.
- Commonwealth Bank of Australia and Lloyds Bank: acting for financiers in the Supreme Court of Western Australia and High Court in relation to the enforcement of their security over the Raine Square development and an associated $600m damages claim against the financiers.
- Major logistics and infrastructure company: acting in domestic arbitration in relation to claims arising from the design and development of a significant infrastructure project in New South Wales.
- Oil and gas joint venture dispute: acted for an ASX listed company in LCIA arbitration proceedings, successfully defending claims relating to a contractual dispute arising out of a joint venture agreement in North Africa.
